Welcome to Famma. These Terms and Conditions ("Terms") govern your participation in the Famma waitlist. By submitting your email address to join our waitlist, you agree to be bound by these Terms.

1. About Famma

Proofkit is a testimonial collection application designed for freelancers and small businesses. The waitlist is an early access program that allows interested individuals and businesses to register their interest in the product before its official launch.

2. Acceptance of Terms

By joining the Famma waitlist, you confirm that:

  • You have read, understood, and agree to these Terms

  • You have read and agree to our Privacy Policy

  • You consent to receive communications from us as described in our Privacy Policy

  • All information you provide is accurate and truthful

The waitlist is open to individuals and businesses worldwide. While Famma is primarily designed for professional and business use (freelancers, small businesses, and professionals collecting testimonials), there are no strict restrictions on who may join the waitlist.

3.3 One Registration Per Person

You may only register once for the waitlist. Multiple registrations using different email addresses to gain unfair advantage may result in removal from the waitlist.

4. What the Waitlist Provides

Important: While it is our intention to provide early access and exclusive benefits to waitlist members, we cannot guarantee these benefits at this stage of development.

By joining the waitlist, we intend to provide you with:

  • Early access: We intend to grant waitlist members priority early access to Famma when it launches

  • Exclusive launch discounts: We intend to offer special pricing or promotional discounts exclusively to waitlist members

  • Launch notifications: Email updates when Famma becomes available

  • Product updates: Information about product development and features as we progress

Please note that while these are our intentions, circumstances during development may require us to adjust our plans. We will make every reasonable effort to honour these commitments to our waitlist members.

5. Development and Launch Flexibility

While we intend to provide the benefits described above, we cannot make binding guarantees at this stage of development regarding:

  • The exact launch date of Famma

  • The specific features, functionality, or final pricing of the product

  • The exact nature or value of promotional offers

  • The specific order or timing in which waitlist members will receive access

We reserve the right to modify our plans, adjust timelines, or make changes to the product as development progresses. In the event of significant changes that affect our commitments to waitlist members, we will communicate these changes via email.

6. Communications

By joining the waitlist, you agree to receive:

  • Email communications about Famma's launch and updates

  • Marketing and promotional emails about our products and services

  • Information about other products we may develop

You may unsubscribe from these communications at any time by clicking the unsubscribe link in any email or by contacting us directly.

7. Your Responsibilities

You agree to:

8. Removal from Waitlist

  • You engage in fraudulent or abusive behavior

  • We determine it necessary at our sole discretion

9. Intellectual Property

All content, branding, and materials related to Famma, including but not limited to the name "Famma," logos, website content, and promotional materials, are the intellectual property of James Hicks trading as Famma and are protected by copyright, trademark, and other intellectual property laws.

You may not use, reproduce, or distribute any Famma materials without our express written permission.

10. Privacy and Data Protection

Your personal information is handled in accordance with our Privacy Policy and applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

11. Disclaimer of Warranties

The waitlist is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose

  • That the waitlist will be uninterrupted or error-free

  • That any information provided will be accurate or complete

12. Limitation of Liability

To the fullest extent permitted by law, James Hicks trading as Famma shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your participation in the waitlist

  • Any inability to access or use the waitlist

  • Any delay or cancellation of the Famma launch

  • Any communications you receive from us

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify waitlist members by email or through an announcement on our website. Your continued participation in the waitlist after such changes constitutes acceptance of the modified Terms.

The "Last Updated" date at the top of this page indicates when these Terms were last revised.

14. Termination

You may withdraw from the waitlist at any time by:

  • Clicking the unsubscribe link in any email we send you

  • Contacting us at legal@famma.io

We may terminate or suspend the waitlist at any time without prior notice.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your participation in the waitlist shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and James Hicks trading as Famma regarding your participation in the Famma waitlist and supersede all prior agreements and understandings.

19. Acceptance

By joining the Famma waitlist, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
